Please read these terms carefully before using ActiveLayer services.

Introduction

Welcome to ActiveLayer. These Terms of Service (“Terms”) govern your access to and use of the ActiveLayer website, API, WordPress plugin, and related services (collectively, the “Service”) operated by ActiveLayer LLC (“ActiveLayer”, “we”, “us”, or “our”).

ActiveLayer provides spam detection and analysis services for contact form submissions, comments, and other user-generated content through our REST API and integrations.

Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

  • You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service.
  • If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
  • Your continued use of the Service after any modifications to these Terms constitutes acceptance of those changes.

Account Registration

To access certain features of the Service, you must register for an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.

Description of Service

ActiveLayer provides:

  • Spam Detection API: REST API endpoints for analyzing form submissions, comments, and messages for spam indicators.
  • WordPress Plugin: Integration plugin for WordPress websites to automatically check form submissions.
  • Dashboard: Web interface for managing API keys, viewing detection logs, and configuring spam settings.
  • Detection Scoring: Algorithmic analysis that returns spam probability scores, verdicts, and confidence levels.
  • Feedback System: Ability to submit feedback on detection accuracy to improve the service.

The Service is provided on a subscription basis with different tiers offering varying request quotas and features.

API License and Usage

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our API.

Rate Limits

50 requests per minute per API key. Exceeding this limit will result in 429 responses.

Monthly Quotas

Request limits vary by subscription plan. Monitor usage via the /stats endpoint or dashboard.

API Key Security

  • Keep your API keys confidential and secure.
  • Do not share API keys publicly or embed them in client-side code.
  • Use environment variables or secure secret management systems.
  • Regenerate keys immediately if you suspect they have been compromised.
  • We may revoke keys that appear to be compromised or misused.

Payment Terms

Subscription Plans

ActiveLayer offers multiple subscription tiers including free and paid plans. Paid subscriptions are billed on a monthly or annual basis as selected during signup.

Billing

  • Subscription fees are charged in advance for each billing period.
  • All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
  • We reserve the right to change pricing with 30 days’ notice to existing subscribers.

Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account dashboard.

Refund Policy

Refund requests made within 14 days of initial subscription may be considered on a case-by-case basis. Contact [email protected] to request a refund.

User Responsibilities

As a user of the Service, you agree to:

  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Ensure that any data you submit to the Service complies with applicable laws and regulations.
  • Maintain appropriate security measures for your API keys and account credentials.
  • Respect the rate limits and usage quotas associated with your subscription plan.
  • Not attempt to circumvent or disable any security features of the Service.
  • Not use the Service to process content that you do not have the right to process.

Prohibited Activities

You may not use the Service to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Share, resell, or redistribute API access without authorization.
  • Use automated means to access the Service beyond the intended API usage.
  • Submit content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
  • Attempt to bypass rate limits or abuse the Service infrastructure.
  • Use the Service to send spam or unsolicited communications.

Intellectual Property

Our Property

The Service, including its original content, features, functionality, algorithms, and underlying technology, is and will remain the exclusive property of ActiveLayer LLC. The Service is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you submit to the Service for spam analysis. By submitting content, you grant us a limited license to process, analyze, and store that content solely for the purpose of providing the Service and improving our detection algorithms.

Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to compensate you.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

By using the Service, you acknowledge that:

  • Content submitted for spam analysis may be stored and processed to provide the Service.
  • Aggregated and anonymized data may be used to improve our detection algorithms.
  • You are responsible for ensuring you have the necessary rights and consents to submit content for analysis.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate or reliable.
  • All spam will be correctly identified or that all legitimate content will pass through.
  • Any errors in the Service will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACTIVELAYER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless ActiveLayer LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any content you submit to the Service.

Termination

Termination by You

You may terminate your account at any time by cancelling your subscription through your account dashboard or by contacting us. Upon termination, your right to use the Service will immediately cease.

Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms.
  • Fraudulent, abusive, or illegal activity.
  • Non-payment of fees.
  • At our sole discretion, with or without cause.

Effect of Termination

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Posting the updated Terms on this page with a new “Last updated” date.
  • Sending an email notification to the address associated with your account.
  • Providing notice through the Service dashboard.

Material changes will be effective 30 days after notice is provided. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
